The present petition has been filed by the petitioner praying inter alia for quashing the Inquiry Report dated 28.1.2016, submitted by the Inquiry Committee constituted by the respondent No.1 to enquire into the charges framed against the respondent No.3.

It has been enquired from learned counsel for the petitioner as to whether the report of the Inquiry Committee has been accepted by the respondent No.1 and acted upon.

In response, he states that though the report has been submitted by the members of the Inquiry Committee, but it has not been accepted so far.

As the report of the Inquiry Committee has yet to be accepted, this Court is prima facie of the view that the present petition is pre-mature. W.P.(C) 5230/2016

At this stage, counsel for the petitioner seeks leave to withdraw the present petition, while reserving the right of the petitioner to seek his remedies as per law in the event the Inquiry Report is accepted by the University which, according to him, is contrary to the Guidelines laid down by of the UGC.

Leave, as prayed for, is granted.
