The application is disposed of.

IA No.8902/2016 This is an application filed on behalf of the plaintiff for enlargement of the time to collect the plaint. By an order 14.09.2015, this Court accepted the contention of the defendant that this Court had no territorial jurisdiction and had ordered the plaint to be returned for presentation to the Court of competent territorial jurisdiction in Ranchi within four weeks. It was further direction that failing which, the suit would stand dismissed.

The plaintiff has filed the present application stating, inter alia, that aforesaid directions had not been communicated by its advocate. Further the promoters of the plaintiff were embroiled in certain other litigations and therefore, could not address to the affairs of the

plaintiff company.

In view of the explanations provided, the application is allowed and the plaintiff is permitted to collect the plaint from the Registry of this Court within ten days from today. Needless to say that all the contentions of both sides are open.

The application stands disposed of.
