BAIL APPLN. 1117/2018 Initial submissions made on behalf of either side. Vide the present application, the applicant seeks grant of anticipatory bail submitting inter alia to the effect that the allegations of alleged cheating have been made against the co-accused Munna Singh which Munna Singh is in custody and the applicant is willing to return the amount of money which he has received from the complainant i.e. a sum of Rs.83,500/-. It has been submitted that the applicant cannot be penalized for the acts done by coaccused. Reliance has also been placed on behalf of the applicant on BAIL APPLN. 1117/2018

proceedings in Crl.M.C. 2470/18 and the same is stated to be listed before this Court on 24.07.2018.

Inter alia on behalf of the State, reliance has been placed during the course of the investigation and states that under Section 161 of the Code of Criminal Procedure, 1973 of the complainant as per which it is indicated that the applicant and the co-accused had declined to give possession of the premises qua which the complainant is stated to have given Rs.7,03,000/- and has been cheated in relation thereto.

Presently, there is no ground for anticipatory bail. The application is declined.
