% 15.05.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent no. 2 is present in Court and accepts notice. Respondent no. 2 has been identified by SI Samrat of Police Station Harsh Vihar. Petitioner no.1 is father of petitioner no.2 and respondent no.2 (complainant) is wife of petitioner no.2.
Respondent no.2 submits that she has settled the matter with the petitioners of her own free will, voluntarily and without any undue force, pressure or coercion and is living with the petitioners. She further says that she has no objection in case FIR No.
51/2016 under Sections 323/354/506/34 IPC registered at Police Station Harsh Vihar and the consequent proceedings emanating therefrom are quashed against the petitioners.
Keeping in mind that husband and wife have started living together in
the same house after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 51/2016 under Sections 323/354/506/34 IPC registered at Police Station Harsh Vihar and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
