% 28.01.2019 Petition on merits has been dismissed vide order dated 16.05.2018 but only limited notice was given for enlargement of time for vacation of subject premises.

Learned counsel for the petitioner says the petitioner shall vacate the premises and handover its vacant and peaceful possession to the respondent by 31.03.2020. Learned counsel for the respondent says he shall have no objection to the use of the premises by the petitioner herein provided he should pay the user and occupation charges as per the market rental which he says is Rs.6,000/- per month. The same is disputed by learned counsel for the petitioner and he says that the rental would not be more than Rs.1,000/- per month.

In the circumstances, as an interim measure let the petitioner pay to the respondent an amount of Rs.1,500/- per month w.e.f. 01.11.2018 as user/occupation charges till the vacation of the premises by the petitioner on or before 31.03.2020. The arrears of the occupation/user charges shall be paid to the respondent within four weeks from today and the future user/occupation charges shall be paid on or before 7th of each calendar month. The water and electricity charges be paid as per actuals. The usual undertaking to this effect shall be filed by the petitioner within four weeks from today. Any default in payment of user/occupation charges shall entail eviction forthwith.
