O R D E R

% 25.07.2018 CS(COMM) 873/2018 and I.A.9722/2018 1.

The plaintiff and defendant No.1 have amicably settled their disputes. The terms of the settlement are recorded in I.A.9722/2018 which is signed by both the parties and is supported by their respective affidavits. Defendant No.1 is present in Court and has produced his Aadhaar Card. The photocopy of the same is taken on record. Defendant No.1 confirms the terms of the settlement recorded in I.A.9722/2018. I.A.9722/2018 is marked as Ex.C1. The settlement between the plaintiff and defendant No.1 is taken on record.

Learned counsel for defendant No.2 submits that defendant No.2 has removed the listing of defendant No.1 and if defendant No.1 again lists on website of defendant No.2, the plaintiff should inform defendant No.2 whereupon defendant No.2 shall remove the impugned listing within three working days. In view of the statement made by learned counsel for defendant No.2, learned counsel for the plaintiff does not press the suit

against defendant No.2.

The suit is decreed in terms of the settlement Ex.C1. The parties shall remain bound by the settlement. Pending applications are disposed of. 4.

Learned counsel for the plaintiff seeks refund of 50% of the Court fee under Section 16A Court Fees Act.

Since the parties have arrived at a settlement at the initial stage, the Registry is directed to issue necessary certificate for refund of 50% Court fees to the plaintiff under Section 16A of the Court Fees Act. 6.

Copy of this order be given dasti to learned counsels for the parties under signature of Court Master.
