MAT.APP.(F.C.) 110/2018 and CM No. 20207/2018 Challenge in this appeal is to the order dated 03.04.2018 by which the right to lead evidence of the appellant except the appellant-wife herein stands closed.

Notice was issued in the matter. Counsel for respondent has appeared and has very fairly submitted that the cost has been waived and he would have no objection if the order is set aside provided the appellant files her evidence by 06.08.2018 so that the date fixed before the Family Court on 10.08.2018 is not wasted.

Accordingly, the order dated 03.04.2018 is set aside. The appellant is granted one opportunity to file affidavits by way of evidence on or before 06.08.2018. It is agreed that no further opportunity will be

granted. The witnesses shall remain present in Court on 10.08.2018, the date already fixed before the Family Court.

With the above directions, the appeal is disposed of. Dasti.
