% 12.02.2019 This matter is listed today for orders in respect of transfer of this suit on pecuniary jurisdiction ground in view of circular no. 106/DHC/Orgl/2019 dated 30.01.2019 of Delhi High Court. This is a suit for permanent injunction, restraining infringement of trade mark and copy right, passing off, damages and rendition of account etc.

Ld. counsel for plaintiff submits that present suit is related to infringement of trade mark, copy right and passing off, hence, this suit is liable to be governed by Trade Mark Act, 1999 and since plaintiff is running this business from South East District, hence, in view of Section 134 of aforesaid Act suit is liable to be transferred to District Courts, South East District, Saket.
