% 03.11.2017 I.A. 12881/2017 in CS(COMM) 248/2017 Present application has been filed under Order 23 Rule 1(3) read with Section 151 CPC seeking permission to withdraw the present suit with liberty to institute a fresh suit, if required, after process of reconciliation and verification of accounts is over.

Learned counsel for plaintiff states that as per the paras 3.13(b) and 18 of the Memorandum recording Family Settlement dated 28th June, 2017, the parties have agreed to withdraw the pending cases in a bid to amicably resolve the matter.

Keeping in view the aforesaid fact, the plaintiff is permitted to withdraw the present suit in view of the Memorandum recording Family

Settlement dated 28th June, 2017. However, plaintiff is granted liberty to file a fresh suit if the matter is not amicably resolved after the process of reconciliation and verification of accounts is over. With the aforesaid observation and liberty, present application and suit stand disposed of.
