% 01.10.2018 ARB.P. 743/2018 & I.A. No.13446/2018 Learned counsel for the petitioner seeks to withdraw the captioned petition and the application with liberty to approach the Court once again along with an agreement which concerns the parties herein.

To be noted, the petitioner has placed on record an agreement which concerns the respondent's sister concern i.e. Gaursons Promoters Private Limited.

Clearly, based on the same, the respondent, in this case, cannot be bound down to have the disputes referred to an Arbitral Tribunal. The petition and pending application are dismissed as withdrawn with liberty as prayed for.
