% 07.11.2016 CM No.28470/2016 (for condonation of delay) We have heard the learned counsel for the parties. The delay is condoned.
The application is disposed of.
FAO(OS) 234/2016 and CM No.28469/2016 We have heard the learned counsel for the parties. It is the case of the appellant that her share in the subject property is one-twelfth.
The value of her share comes to Rs.20 lacs.
Therefore, according to the learned counsel for the appellant, the value of the subject property would be Rs.2.4 Crores. It is also further submitted that for the purpose of jurisdiction, the value of the subject property at Rs.2.4 Crores has to be considered.
The learned counsel for the respondents also have no objection to this submission.
Since this would fall within the pecuniary jurisdiction of this Court, the appeal is allowed and the suit shall be tried before the Original Side of this Court.
The learned counsel for the appellant shall, in order to avoid any controversy, carry out appropriate amendments in the plaint. The suit shall be listed before the concerned learned Single Judge in the first instance on 15.11.2016. We request the learned single Judge also to expedite the progress in the suit inasmuch as defendant No.2 is a senior citizen of about 82 years of age.
The appeal stands disposed of.
