Mr. Ruchir Bhatia, learned Senior Standing Counsel for the appellant fairly informs that in an identical matter of the respondent-assessee's own case for Assessment Year (AY) 2016-17, this Court had taken a view against the appellant-Income Tax Department.

Having heard learned counsel for the appellant and on perusal of the memo of appeal; order of the Income Tax Appellate Tribunal dated 25.09.2023 and our dated 30.04.2026 passed in ITA No. 356/2026, we are of the view that the present appeal for AY 2015-16 also deserves to be rejected for the same reasons, which we have given in the order dated 30.04.2026.
