% 21.05.2018 After some arguments, learned counsel for the petitioners submits that since the matter is already listed before the Revenue Assistant/Sub Divisional Magistrate, Alipur tomorrow i.e. 22nd May, 2018, the petitioners will appear before the said authority and apprise it about the notification dated 18th May, 2017, according to which the petitioners claim that the village in which the land in question is situated, has already been declared to be an urban area. The petitioners are, accordingly, granted leave to withdraw the present petition with liberty to approach the concerned SDM, Alipur. It is expected that the SDM will, before passing any further order, consider the effect of the said notification. It is, however, made clear
that in case the petitioners are aggrieved by the order of SDM, they would be at liberty to take legal recourse as permissible under law. The petition and the pending applications are dismissed as withdrawn with liberty as prayed for.
