After arguments, it is agreed and the impugned judgment of the Trial Court dated 7.2.2018 dismissing the suit as time barred is set aside, however, whether or not the suit is barred by limitation will be a factual issue which will be framed in the suit and will be decided at the stage of final arguments after trial.

Parties to appear before the District & Sessions Judge, South East, Saket Courts, New Delhi on 23rd October, 2018 and the District & RFA No.440/2018

Sessions Judge will now mark the suit for disposal to a competent court in accordance with law and the observations made in the present order. 3.
