This petition under Article 227 of the Constitution of India impugns the order (dated 19th April, 2016 of the Court of learned Additional District Judge, West, Tis Hazari Courts, Delhi) of dismissal of application filed by the petitioner for review of the judgment dated 16th December, 2015 in MCA No.12/2014 of dismissal of an appeal preferred by the petitioner against the order of the suit Court of dismissal of an application filed by the petitioner under Section 340 of the Cr.P.C.

The petitioner has not challenged the order dated 16th December, 2015 and has merely challenged the order of dismissal of the application seeking review thereof (see Order XLVII Rule 7 of the CPC). 3.

Against an order of dismissal / rejection of a review application no remedy lies.

The counsel for the petitioner withdraws this petition with liberty to take appropriate remedies.
