% 08.04.2016 CM No.13198/2016 By the joint application moved by the appellant and the claimants, prayer is made for permission to withdraw the appeal. Heard.
On being asked the counsel for the appellant submits that the demand draft whereby the amount was remitted to the tribunal on the basis of recovery through attachment has been traced on the record of the tribunal. The counsel on both sides now clarify that in terms of directions of the tribunal, the attachment warrant was issued on the basis of report of the Nazir about the non-compliance with the award, even without the need for any execution application being taken out by the claimants. In this view, the prayer is allowed.
The appeal is dismissed as withdrawn.
