% 09.05.2016 The respondent herein has filed OA No. 966 of 2016, which is being contested by petitioner. In this OA, an interim order was passed on 10th March, 2016, which was operative till 28th March, 2016. The order dated 28th March, 2016 is not on record. However, the order dated 8th April, 2016 is on record. The said order lists the OA on 9th May, 2016 i.e. today. We are informed by the petitioner that the OA is listed for hearing on 13th May, 2016. In these circumstances, we are not inclined to interfere with and interject the proceedings which are pending before the Tribunal as the said proceedings are being taken up for hearing virtually on day-today basis. It is not a case where a long date has been given after

granting an interim stay. The petitioner has raised contentions including allegations against the respondent and, therefore, his contractual employment was no renewed. These contentions can be raised by the petitioner before the Tribunal. It will open to the respondent to contest the said contentions.

At this stage, we are not inclined to issue notice. The writ petition is dismissed, giving liberty to approach the High Court if required and necessary. We have not expressed any opinion or recorded any finding on merits.
