O R D E R

% 27.01.2017 By the present petition the petitioner seeks anticipatory bail in case FIR No.320/2015 under Sections 498A/406/34 IPC registered at PS Roop Nagar.

The petitioner is the husband of the complainant. He states that during the pendency of the present application for bail a settlement has been arrived at between the parties and both the petitioner and the complainant have agreed to take divorce by mutual consent and in lieu of all her claims of maintenance, istridhan, alimony, etc., the petitioner has to pay her a sum of ₹10 lakhs out of which ₹2 lakhs has already been paid. Copy of the memorandum of settlement has been handed-over which is taken on record. BAIL APPLN. 916/2016

In view of the fact that parties have entered into a settlement, I deem it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed.
