It is pointed out that on 26.10.2017, the matter was restored. In the meantime, the petitioner has opted to file insolvency proceedings before the NCLT which is pending adjudication. As there are two parallel proceedings, the petitioner seeks to withdraw the present petition. The application is allowed.

CO.PET. 417/2012 The petition is dismissed as withdrawn.
