Mr.Fanish K. Jain, learned counsel for the petitioner on instructions submits that petitioner is giving offer to the respondent that the respondent may receive the key of the suit property which is lying deposited with the learned Trial Court. Learned counsel for the petitioner clarifies that this offer is being given by the petitioner without prejudice to the rights and contentions of the parties.

Mr.Sandeep Sharma, learned counsel for the respondent on instructions submits that respondent is ready to receive the key from the learned Trial Court. However, receiving of the key pursuant to the offer given by the learned counsel for the petitioner, is also without prejudice to the rights and contentions of the parties.

In view of the above offer given by learned counsel for the petitioner and accepted by learned counsel for the respondent, respondent is at liberty to receive the key from the learned Trial Court and this shall be without prejudice to the respective rights and contentions of the parties. CM(M) 497/2016

Both the parties have agreed that so far as machinery lying in the suit property is concerned, it shall be subject to the decision of the learned Trial Court in Civil Suit No.523/2013 titled Shri Jaideep Jain vs. M/s Aditi Engineering Works Pvt. Ltd.

The petition is disposed of in above terms.

Copy of the order be given dasti to the parties. CM No.19355/2016 (stay) Dismissed as infructuous.
