% 06.11.2015 Issue notice. Mr. Prashant Sivarajan, Advocate appearing on behalf of the respondents accepts notice.
The application seeks termination of the proceedings in this writ petition. The petitioner further seeks liberty in terms of Para 39 of the Supreme Court's Judgment in Union of India Vs. Major General Shrikant Sharma with CA No. 7400/2013 (reported as 2015 (3) SCALE 546). The Supreme Court had held that High Court cannot exercise its jurisdiction against the orders of the Armed Forces Tribunal and that an appropriate remedy would be to approach the Supreme Court after obtaining permission. This was so observed in Section 30-31- as observed in para 39 of Shrikant Sharma's Case (supra). In view of this development, the proceedings in this writ petition are hereby terminated. It is open to the writ petitioner to seek appropriate remedies in para 39 of Shrikant Sharma's Case (supra).
The writ petition is disposed of in above terms. S. RAVINDRA BHAT, J DEEPA SHARMA, J NOVEMBER 06, 2015 sapna
