O R D E R

% 11.12.2018 During the course of hearing, petitioner and respondent no. 2, who are present in Court, submit that the matter has been settled between them. Respondent no. 2 says that petitioner has already paid `1,00,000/-. Respondent no. 2 further says that petitioner has agreed for release of `1,00,000/- lying deposited in this Court to him together with interest accrued thereon.

Petitioner says that he has no objection in case the amount lying deposited in this Court is released to respondent no. 2. It is submitted that settlement has been arrived at between the parties for `2,00,000/- and the

interest accrued on the amount lying deposited in this Court. Respondent no. 2 says that he has no objection in case offence under Section 138 of the Negotiable Instruments Act, 1881 ("the Act", for short) is permitted to be compounded.

In view of the settlement arrived at between the petitioner and respondent no.2, offence under Section 138 of the Act is permitted to be compounded and the petitioner is acquitted.

Let `1,00,000/- lying deposited in this Court together with interest accrued thereon, be released to respondent no. 2 by the Registry forthwith. It is pointed that `1,50,000/- is lying deposited in the trial court. Let `1,50,000/- with interest accrued, if any, be released by the trial court to the petitioner.

Petition is disposed of in the above terms.
