O R D E R

% 27.09.2018 Learned counsel for the petitioner submits that petitioner was not identified by the eye witness in the TIP proceedings held after the arrest of petitioner. Petitioner has been identified in Court after a delay of one year, which is suspicious. Learned APP submits that ₹1.4 lacs was recovered from the petitioner, out of the total robbed amount. Learned counsel submits that PW2 Ashok Chabra has not identified the money allegedly recovered from the petitioner.

It is submitted that the petitioner is in custody for the last one and a half years, inasmuch as, eye witnesses have already been examined, therefore, petitioner may be admitted to bail. Keeping in mind the facts and circumstances of the case, petitioner is

admitted to bail, subject to his furnishing a personal bond in the sum of ₹25,000/- with one surety in the like amount to the satisfaction of the trial court.

Bail application is disposed of in the above terms. Dasti.
