The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.27/2016 registered under Section 376 IPC at PS Kanjhawala. Status report is on record.

I have heard the learned counsel for the parties and have examined the file.

The petitioner is in custody since 01.04.2016. Upon completion of investigation, a charge-sheet has since been filed in the Court. The parties were acquainted with each other since long. There was marriage proposal between the two which could not materialise.

Physical relations took place between the two several times.

When the marriage did not take place, the instant FIR was lodged. At the time of her medical examination, allegedly the BAIL APPLN. 1027/2016

prosecutrix was having eight months pregnancy. Status report reveals that she suffered miscarriage in an incident at home. 3.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 40,000/- with one surety in the like amount to the satisfaction of the Trial Court.

The bail application stands disposed of.
