We are informed by Mr. Sanjay Jain, ld. ASG that against the order dated 15th May, 2017 passed by the ld. Trial Judge, the Enforcement Director has filed a criminal revision which has been registered vide diary No.307391 and is likely to be listed on 14th July, 2017.

In this matter a complaint has been received from the Enforcement Director on the administrative side which is being examined by the Vigilance Committee for judicial officers of this court.

Let a copy of the orders dated 17th May, 2017, 24th May, 2017 and today be placed before the same committee. W.P.(C) 3985/2016

Mr. Ajay Khanna, ld. counsel appearing for the writ petitioners prays for leave to withdraw this writ petition on the ground that the petitioners have been discharged by the judgment dated 15th May, 2017 of the Trial Judge. It is pointed out that by the present writ petition, the writ petitioners were assailing the action taken by the Enforcement Director against the petitioners under the Prevention of Money Laundering Act, 2002 and in view of the discharge, the entire prayer lapses.

The petitioners are the dominus litus. Therefore, the prayer for withdrawal of the writ petition cannot be opposed on any legally tenable ground.

Accordingly, this writ petition and pending application are dismissed as withdrawn.
