Learned counsel for the respondents has handed over a cheque of Rs. 1 lakh towards the principal amount to learned counsel for the petitioner today in Court.

Learned counsel for the respondents submits that respondents shall deposit balance claim amount of Rs.2,59,887/- with the Registrar General of this Court within one week from today and the said amount be released to the petitioner subject to outcome of the Special Leave Petition to be filed by the respondents. It is further submitted that the petitioner should furnish a security to the satisfaction of the Registrar General of this Court to refund the said amount with interest @ 7.5% per annum upon the respondents succeeding in SLP before the Supreme Court.

Since the respondents have not yet filed the SLP, it would be sufficient for the petitioner to furnish an undertaking instead of a security. The petitioner is directed to furnish an undertaking to the Registrar General

of this Court to refund the amount paid by the respondents in the event of respondents succeeding SLP to be filed by them. Upon filing the same, amount of Rs.2,59,887/- to be deposited by the respondents be released to the petitioner.

This petition is disposed of in the above terms with liberty to petitioner to revive the same if the occasion so arises. J.R. MIDHA, J.
