Learned APP accepts notice for respondent no.1.
Respondent no.2 is present in Court and accepts notice. She has been identified by SI Jasmer Singh of police station Jahangir Puri. Respondent no.2 submits that she has settled the matter with the petitioner no.1 of her own free will and without any undue force, pressure or coercion before the Delhi Mediation Centre, Rohini Courts, Delhi vide Settlement Agreement dated 17th May, 2016.
She further submits that she has received `30,000/- from the petitioner no.1, in terms of the settlement agreement. She further submits that she is living with her husband, that is, petitioner no.2, therefore, she has no objection in case FIR No. 138/2007
under Sections 498A/406/34 IPC registered at police station Jahangir Puri is quashed against the petitioners.
Keeping in mind the above facts and circumstances more particularly that respondent no.2 is living with petitioner no.2, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
