% 18.05.2018 Vide the present petition, the petitioner has sought a direction to the respondents to implement the order dated 09.01.2014 passed by this Court in W.P.(C)No.6845/2013, whereby the respondents had been directed to reconstruct the file in respect of the petitioner application within six weeks from the date of the petitioner's furnishing the requisite documents and, thereafter, process his case within a further period of eight weeks.
Mr. Yeeshu Jain, who appears on advance notice for the respondent no.1, submits that though this Court on 09.01.2014 granted only two weeks time to the petitioner to submit the requisite documents, the petitioner had submitted those documents only after an inordinate delay and on this ground the respondents have till date not reconstructed the file, though the same is under process.
Mr.Jain also draws my attention to the reply dated 04.12.2017 obtained by the petitioner under the RTI Act, whereby the petitioner has been categorically informed that upon receipt of his representation dated 11.10.2017, the process for reconstruction of file in terms of the orders passed by this Court was being carried out and as soon as the file is reconstructed the seniority number will be duly allotted to the petitioner.
Mr.Jain further submits that the file would be positively reconstructed within a period of four months and, in case, any further documents are needed from the petitioner, the same would be communicated to the petitioner promptly and a copy of such communication would also be sent to the learned counsel for the petitioner, who will then submit the additional documents, if any required within two weeks thereafter. Upon the petitioner furnishing the additional documents required, if any, the respondent will pass a reasoned and speaking order deciding the petitioner's application within a further period of 3 months.
In view of the statement made by the learned counsel for the respondents, the petitioner does not wish to press the present petition. The petition alongwith pending application is dismissed as not pressed.
