% 24.05.2018 Notice. Learned APP accepts notice on behalf of respondent No.1. Respondent no.2 is present in the Court and has been identified by the Sub Inspector Vikram Singh Police Station Punjabi Bagh. Respondent No.2 submits that he has settled the matter with the petitioners, vide a Memorandum of Understanding dated 09th March, 2018. Respondent No.2 further submits that he has received `2,50,000/- out of total settled amount of `4,50,000/-. Petitioner No.1 has handed over a cheque for `2,00,000/- to the respondent No.2, photocopy whereof has been placed on record. Cheque has accepted by respondent No.2, subject to its realization. Respondent no.2 says that he has no objection if FIR no. 188/ 2017 under Sections 420/406/34 IPC registered at police station Punjabi Bagh is quashed, subject to encashment of the aforesaid cheque. Keeping in mind the settlement arrived at between the petitioners and

respondent No.2, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR no. 188/ 2017 under Sections 420/406/34 IPC registered at police station Punjabi Bagh, which is at the investigation stage, is quashed, subject to encashment of aforesaid cheque.

Petition is disposed of in the above terms.
