CM(M) 447/2016 & C.M. No.17300/2016 Petitioner is aggrieved by the statement of DW-2 recorded on 09.3.2016. This witness had been summoned from the MTNL, Rajouri Garden. Contention of the petitioner before this Court is the original summoned record had been produced by the witness but the Court did not permit the original document to be exhibited. Photocopies of the same had also not been permitted to be taken on record.

This Court is surprised if summoned record from the department had been produced in the Court why the Trial Court did not permit the original record to be exhibited. This matter requires

reconsideration. Trial Court shall reconsider the same on an appropriate application to be filed by the petitioner. With this direction petition disposed of.
