After arguments, this appeal is disposed of by consent order that the impugned judgment dated 31.1.2018 will stand but with the modification that the appellant will be liable to pay charges at Rs.3,000/- per month from September, 2011 till date and for the months of August, 2018 and September, 2018, inasmuch as, as agreed the appeal is not pressed with respect to the decree for possession and appellant undertakes to hand over vacant physical possession of the suit premises to the respondents/plaintiffs on or before 30.9.2018. Before 30.9.2018, appellant will clear all charges at Rs.3,000/- per month from September, 2011 and also clear all payment
towards electricity, water etc.

Let appellant file an undertaking in terms of the present order within one week and on the appellant filing the undertaking and complying with the terms of the same, the present order modifying the impugned judgment and decree dated 31.1.2018 will stand with time being granted to the appellant to vacate the suit premises on or before 30.9.2018. 3.
Appeal is accordingly disposed of in terms of aforesaid consent order.
