This is an application filed under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an arbitrator. 3.
Mr. Chandan Kumar, who, appears on advance notice on behalf of the respondent says that pursuant to the notice dated 26.05.2017, sent by the petitioner to the respondent, the respondent has already appointed an Arbitrator.

Learned counsel for the respondent says that Mr. Rakesh Kumar, exadvisor (Operations) DOT has been appointed as a sole arbitrator to adjudicate the disputes between the parties qua letter dated 14.08.2017. ARB.P. 465/2018

I am further informed that Mr. Rakesh Kumar Sinha has entered upon reference on 24.08.2017. Copies of these letters have been handed over to the counsel for the petitioner.

In these circumstances, counsel for the petitioner says that the petitioner will appear before the learned Arbitrator upon intimation sent to it in that behalf by the learned Arbitrator.

Learned counsel for the respondent says that he will inform the arbitrator about the development which has taken place today and accordingly, request him to issue intimation to the parties which would include the petitioner as to the next date of hearing. 8.
