Heard the learned counsel for both the parties. 2.

As is evident from the order under appeal and the other material placed on record, the appellants/ writ petitioners failed to file the rejoinder despite several opportunities and, therefore, the writ petition could not be heard on merits.

However, the learned counsel for the appellants has now undertaken to file the rejoinder on or before 20.05.2016 without fail. We, therefore, consider it appropriate to advance the hearing of the writ petition. 4.

Hence, the writ petition be listed before the learned Single Judge on 23.05.2016 for directions.

We request the learned Single Judge to hear both the parties and pass

an appropriate order on merits of the case at the earliest. 6.

The date (04.10.2016) fixed in the order under appeal shall stand cancelled. Be listed before the learned Single Judge on 23.05.2016. 7.

The appeal is, accordingly, disposed of.
