O R D E R
% 07.09.2018 Learned counsel for the petitioner submits that all the three witnesses, namely, Deepak Verma, Ashok Verma and Atul Kumar Singh have already been examined and none of these witnesses have identified the petitioner. It is further submitted that no other circumstantial evidence is there against the petitioner to connect him with the offence.
Learned APP submits that one country made pistol was recovered from the petitioner.
Learned counsel for the petitioner submits that there is no FSL report in respect of the bullet, by which deceased was hit, that the same was fired from the country made pistol, allegedly recovered from the petitioner. Petitioner is in custody for the past seven years, therefore, he may be
admitted to bail.
Keeping in mind totality of the facts and circumstances of this case petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of ₹25,000/- with one surety in the like amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms. Dasti.
