W.P.(C) 5876/2018 This is second round of litigation. In the first round, vide order of 4th February, 2010, respondents were directed to consider petitioners' application for allotment of alternate plot. Order of 11th February, 2015 reveals that petitioners' application for allotment of alternate plot in lieu of acquired land stands rejected as the said application was filed beyond the prescribed time limit of one year. It is noted in the impugned order that petitioners' land was acquired on 28th May, 2002 and the application was submitted on 4th June, 2003. The delay is of one week or so. In the facts and circumstances of this case, it is deemed appropriate W.P.(C) 5876/2018
to set aside the impugned order with direction to respondents to consider petitioners' application for allotment of alternate plot in lieu of acquired land, on merits.
Let the needful be so done within sixteen weeks from today. The fate of petitioners' application be made known to them within two weeks thereafter, so that they may avail of the remedies as available in law, if need be.
