1. The Court is informed that the Petitioner has, pursuant to the order dated 25th September 2013, deposited 25% of the tax amount. By the said order, the hearing of the appeal y the Commissioner of Income Tax (Appeals) was directed to continue.

2. Accordingly, it is directed that the impugned order dated 13th June 2013 passed by the Deputy Commissioner of Income Tax shall stand modified to the above extent. However, the further directions regarding the said amount will be made by the CIT (A) at the time of passing the final order disposing W.P.(C) 5939/2013 Page 1 of 2

of the said appeal. It is clarified that this order should not be viewed as an expression by the Court of any opinion on merits. The CIT (A) will take an independent decision in the appeal.

3. It will be open to the parties to make a request before the CIT(A) to expeditiously dispose of the pending appeals for the Assessment Years ('AYs') 2005-2006 to 2008-09 and in any event not later than one year from the date of this order.
