% 24.09.2018 CM No. 38912/2018 (under Order 23 rule 1 r/w Sec.151 CPC) The rule is indicated to have been issued on 9.7.2013 and the matter is taken up on CM No.38912/2018 an application filed on behalf of the petitioner under Order 23 Rule 1 CPC filed on behalf of All India Industrial Finance Corporation Employees Association by the learned counsel for the petitioner whose vakalatnama is found to be placed on record in part 'B' of the record submitting to the effect that a settlement has been arrived at between the parties. The notice of the application is accepted on behalf of the respondent. On a perusal of the impugned award dated 30.6.2010 of the Presiding Officer of the CGIT-I, Karkardooma, it is apparent that the grievance related to Mr.Madan Lal, the General Secretary of the Association as per the record. It has been submitted onbehalf of either
side that the petitioner is in fact not even in existence for the last six years observed herein above the impugned award indicates that the grievance mainly was of Mr.Madan Lal, the then General Secretary of the Association with whom the settlement is indicated to have been arrived at as per the settlement in the application. This aspect is not refuted on behalf of the respondent. In view of the averments in the application, the prayer in CM No.38912/2018 is allowed and the petition is thus dismissed as withdrawn.
