% 03.02.2016 Earlier, in terms of order dated 10/1/2014 this matter was adjourned sine die but subsequently a Court Notice was issued to the parties after observing that the instant matter is likely to be transferred as its value for the purpose of jurisdiction is less than rupee two crores. Accordingly, petitioner has appeared along with his counsel.

Ld. counsel for plaintiff seeks permission to withdraw the present matter and orally prays for revival of the suit to its original number, as he only intends to withdraw the suit.

Heard. Since the ld. counsel for plaintiff intends only to withdraw the suit, the oral request of ld. counsel for plaintiff is accepted and „notice to the defendant‟ is dispensed with. Heard. Suit stands restored to its original number.

In view of separate statement of plaintiff recorded today, this suit stands dismissed as withdrawn.
