O R D E R

% 20.07.2018 By this petition, the petitioner seeks parole on the ground that he has to partition the ancestral property and also to maintain social ties. A status report has been filed. As per the status report the family of the petitioner was found residing at H.No. 1169, Gali Jamun Wali, Punjabi Phatak, Ballimaran. The unmarried sister of the petitioner was also found residing over there. Father of the petitioner has passed away in the year 1996 thus the petitioner wants the partition of the property. The Competent Authority rejected the parole of the petitioner on the ground that the petitioner is a bad character and his co-accused is absconding from Jail.

Undoubtedly the petitioner is involved as many as nine cases, however, a perusal of the nominal roll reveals that the petitioner is being W.P.(CRL) 1621/2018

granted regular parole and furlough, the last furlough was granted by the DG prisons w.e.f 1st February, 2018. There is no allegation that when the petitioner was released on parole/furlough he was involved in any criminal activity and did not surrender in time.

Considering the fact that the ancestral property is to be divided and the last parole granted to the petitioner was w.e.f 24th April, 2017 this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court.

Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
