% 11.03.2016 Crl.M.A.No.4445/2016 (for modification of order dt.01.05.2015) 1.

Vide the instant application, the applicant/State seeks modification in the order dated 01.05.2015 to the extent that summoning order dated 08.12.2003 was quashed qua petitioner only. Also seeks clarification that in the aforesaid order the date of summoning order is inadvertently mentioned as 08.12.2013 instead of 08.12.2003.

It is noted that vide order dated 01.05.2015, this Court passed the order as under:- "

Consequently, impugned summoning order of 8th December, 2013 (Annexure A-5) is hereby quashed with liberty to the respondent to proceed against Mr.Chetan B. Trivedi, Supervisor Chemist, who was successor of petitioner at the relevant time."

I hereby make it clear that petitioner Mr. J.B. Pandit filed the captioned petition and the liberty was granted to the respondent to proceed against Mr.Chetan B. Trivedi, Supervisor Chemist, who was the successor of the petitioner at the relevant time.

I further make it clear that date of impugned summoning order in the aforenoted order shall be read as 08.12.2003 instead of 08.12.2013. 5.

It is also clarified that summoning order dated 08.12.2003 and complaint shall remain in force against the other accused persons as vide aforenoted order dated 01.05.2015, the summoning order dated 08.12.2003 was quashed qua petitioner J.B.Pandit only.

Accordingly, the instant application stands disposed of. 7.

A copy of this order be given dasti to the learned counsel for the applicant.
