% 16.03.2016 CS(OS) 769/2015 Learned counsel for plaintiff has drawn my attention to previous order dated 06.11.2015 of Hon'ble Court to submit that inspite of specific directions, neither advance copy of application for condonation of delay vide IA No. 23139/2015 has been supplied nor the cost of Rs. 5000/- was paid by defendant no.1within one week of the said order or even till today. Since the present matter is to be transferred in view of notification no.27187/DHC/Orgl. dated 24.11.2015 to the concerned district court having pecuniary and territorial jurisdiction, therefore, this court has became functus officio and the contention of learned counsel for the plaintiff shall be dealt with by the successor court only.
