After arguments, this appeal is disposed of as not pressed but appellant as prayed for is granted time to vacate the suit premises on or before 31.12.2018.

Let the appellant file an affidavit of undertaking in this Court within a period of two weeks from today to vacate the suit premises on or before 31.12.2018 and also for this period continue to pay the electricity charges, water charges and the admitted use and occupation charges, and on the appellant filing this affidavit of undertaking and complying with the terms of the same, the appellant will have time to vacate the suit premises on or before 31.12.2018.

It is clarified that this Court is not observed one way or the other on the aspect of mesne profits and which issue will be decided by the trial court.

The appeal is accordingly disposed of in terms of the aforesaid observations.
