This petition is filed for the grant of letters of administration without the Will of Lt. Shri Prithvi Nath Kaul Bamzai. The petitioner is the son of Lt. Shri Prithvi Nath Kaul Bamzai who expired at Delhi on 20.08.2007. Besides the petitioner, Lt. Shri Prithvi Nath Kaul Bamzai left behind five other daughters and who were impleaded as respondent nos. 2 to 6 to this petition.

The daughters being the respondent nos. 2 to 6 and who are the sisters of the petitioner, have filed their no-objection affidavits which have been proved and exhibited as Ex. PW1/6 to PW1/10. TEST.CAS. 67/2010

Since this is a case for the grant of letters of administration without the Will annexed, and petitioner is the son of the deceased Lt. Shri Prithvi Nath Kaul Bamzai and who has also otherwise filed an affidavit by way of evidence, exhibited as Ex. PW1/X proving the aforesaid facts, and no one has filed any objections to this testamentary case although citation was published in newspapers 'Dainik Jagran', 'Indian Express' and 'Kashmir Times' (Hindi as well as English edition) and therefore, this petition for the grant of letters of administration is allowed and petitioner will be granted letters of administration on paying necessary Court fee and filing of administration and surety bonds.
Petitioner would file Court fee on the valuation of the immovable property as per the valuation report which has been filed by the Chief Controlling Revenue Authority through the Assessment Collector. This valuation report was filed in terms of the Index dated 27.8.2014.

Petition is accordingly allowed and disposed of in terms of the aforesaid directions.
