% 17.02.2020 Crl.M.A. 42902/2019 The instant application has been preferred by the wife of the appellant seeking abatement of appeal and discharge of surety on account of death of the appellant.

In pursuance to last order, learned Special Public Prosecutor for respondent/ CBI has placed on record Verification Report, wherein it has been stated that factum of petitioner having expired on 17th September, 2019 stands verified. The Verification Report is annexed with a copy of the Death Certificate issued by the competent authority. In view of the aforesaid, the application is allowed for the reasons stated therein and stands disposed of accordingly. CRL.A. 1133/2010
