Learned APP for the State on instructions from the Investigating Officer, who is present in Court, submits that the victim is in the hospital and unable to make a statement.

Learned counsel for the petitioner refutes the submission made by learned APP for the State and submits that the injured is not in the hospital and roaming around the locality and the averment made on behalf of the State is false.

In view of the submission made by learned APP for the State that the injured is in the hospital and unable to make statement, I find no merit in the present anticipatory bail application and the same is hereby dismissed. Copy of this order be given dasti, as prayed. I.S.MEHTA, J MARCH 30, 2017 'dc'
