% 01.09.2015 Defendant nos.1 to 3 have filed their affidavits in terms of order dated 5th August, 2015.
Copies of the affidavits have already been supplied by the learned counsels for the defendants to learned counsel for the plaintiff. Defendant nos.1 to 3 shall remain bound by their statements as contained in the affidavits. Learned counsel for the plaintiff submits that in view of the affidavits filed, suit is not pressed.
Suit is disposed of as not pressed.
Since defendant nos.1 to 3 have made their statement in their affidavits that they have nothing to do with the fixed deposits lying with the
defendant no.4, it will be open for the plaintiff to approach the defendant no.4 for release of the fix deposits and if any such request is made same may be considered by the defendant no.4 in accordance with law. A.K. PATHAK, J.
