Counsel for the petitioner concedes that the petitioner is seeking reinstatement against the order of termination of services, and therefore, it is the Delhi School Tribunal which will have the jurisdiction to hear this matter in view of Section 8(3) of the Delhi School Education Act, 1973 and also so held by the Supreme Court in its judgment in the case of Shashi Gaur Vs. NCT of Delhi, (2001) 10 SCC 445. 2.

Since this petition is pending in this Court for the last many years, therefore, this petition, instead of being dismissed, is transferred for decision to the Delhi School Tribunal (DST) and the DST will keep this W.P.(C) 6640/2010

petition as an appeal filed before it on the date on which this petition was filed in this Court, and will dispose of the appeal in accordance with law. 3.

Parties to appear before the Delhi School Tribunal on 27th March, 2017. Registry to ensure that file of this case is made available to the Delhi School Tribunal on the date fixed.
