In view of the objection taken in the reply by the respondent in paragraphs 5 and 6, learned counsel for the petitioner says that he would want to withdraw the captioned petition.

Paragraphs 5 and 6 of the reply read as follows: "5. That Petitioner (Mr. Kamal Kumar Keshwani) and respondent (DHL Logistics Pvt. Ltd. earlier called DHL Lemuir Logistics Pvt. Ltd.) had entered into a Leave and License Agreement dated 14th March 2011, whereby DHL Logistics Pvt. Ltd. had taken a premises situated at basement, ground and upper two floor of A-138, Okhala Industrial Area, Phase -II, New Delhi, admeasuring 54,360 sq ft. on leave and license basis.

That the Bombay High Court has approved the Scheme of Arrangement in Company Scheme Petition No.726 of 2013 and Petition No. 727 of 2013 vide its order dated 17th December 2013, whereby the Supply Chain business of DHL Logistics ARB.P. 404/2018

Private Limited shall stand transferred to and vested in DHL Supply Chain India Private Limited."

In these circumstances, the petition is dismissed as withdrawn with liberty as prayed for.
