Learned counsel for the appellant says that since the recordal of evidence shall shortly stand concluded, he has instructions not to press the appeal any further.

1.1 In other words, the appellant wishes to prosecute the suit action, with the interim order passed by this Court continuing to operate in the meanwhile.

The statement of the counsel for the appellant is taken on record. 3.

The record shows that the interim order was passed by the Coordinate Bench on 21.05.2018. The relevant part of the said order is extracted hereafter:

"2.

It is directed that till the next date of hearing, respondents shall maintain status quo regarding title, possession and construction on the land admeasuring 9 bighas 12 biswas in khasra no.346 (4-16) and 331 (416) situated in Revenue Estate of Village Ibrahimpur, Delhi." 4.

What is required to be noticed is that the subsequent purchasers who are arrayed as respondent nos. 4 to 6 were added as parties by the coordinate bench only on 19.02.2019.

4.1 Therefore, Mr V.P. Rana, counsel who appears for subsequent purchasers, i.e., respondent nos. 4 to 6 says that the interim order dated 21.05.2018 can be extended to respondent nos. 4 to 6. 5.

It is ordered accordingly.

The appeal is closed.

The interim order dated 21.05.2018, which was made absolute on 28.11.2019, shall stand extended to respondent nos. 4 to 6 and will continue to operate during the pendency of the suit.

The appeal is accordingly disposed of in the aforesaid terms.
