Petitioner seeks quashing of FIR No.434/2014, under Section 324 IPC, Police Station Hazrat Nizamuddin, based on a Settlement. 2.
The petitioner is the daughter-in-law of the complainantrespondent No.2.

Subject FIR emanates out of a matrimonial discord. 4.
Parties have settled their dispute.
Settlement was arrived at before the National Lok Adalat, Dwarka Courts Complex, on 09.12.2017. Parties have settled their dispute not only qua the subject FIR but also qua cross-FIR, registered against her husband and his family.

Petitioner, who is present in Court in person, submits that parties have settled their disputes qua the other FIR and undertakes to consent to the quashing of that FIR as and when appropriate proceedings are filed by the accused. Her undertaking is accepted. 6.
Respondent No.2 is present in Court in person, represented by counsel and is identified by the Investigating Officer. She confirms that the settlement has taken place and further submits that she has settled the disputes with the petitioner. She also submits that she does not wish to press her complaint any further.

In view of the above and keeping in view of the fact that the FIR emanates from matrimonial discord and the parties have resolved their dispute before the National Lok Adalat, Dwarka Courts Complex, on 09.12.2017 and that parties have settled their dispute not only qua the subject FIR but also qua cross-FIR, registered against her husband and his family and further respondent No. 2 does not wish to press her complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the
ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly, FIR No.434/2014, under Section 324 IPC, Police Station Hazrat Nizamuddin and the consequent proceedings emanating therefrom are hereby quashed.
